Claiming dependents on tax returns after divorce

Question:  Can the divorce court order that I'm allowed to claim 1 or more of my children on my tax return?

Answer:   No - divorce court is subject to Texas state law, taxes are subject to federal law, the Internal Revenue Code. Generally the parent with primary custody may claim the child on the tax return. However, the parties may agree to do something else which is reported with Form 8332 on the tax returns.
