Increased Age for Consent to Marriage

Under Texas Family Code section 2.009, the county clerk may not issue a marriage license if either applicant is under 16 years of age.

However, the county clerk may issue a marriage license to an applicant less than 16 years of age if there is either:

1. Parental consent
2. Documentation of a prior dissolved marriage of the applicant
3. A court order
